Legal Mandates
Title VI of the 1964 Civil Rights Act “No person in the United States shall, on ground of race, color or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”
Requires all entities receiving Federal financial assistance, including physicians accepting Medicare or Medicaid, to ensure that LEP persons have meaningful linguistic access to the health services they provide.
Executive Order 13166, August 2000 Requires each federal agency to issue guidance for improving access to programs and activities funded by the agency for LEP individuals.
Office for Civil Rights (OCR) Guidance

Recommends agencies:

  • Assess language needs of population served
  • Develop written policies on how the population can obtain competent language services, both oral and written
  • Train staff for effective implementation of policies
  • Monitor services and policies to ensure LEP individuals meaningfully access services
Americans With Disabilities Act (ADA) of 1990

Provides language access accommodations for individuals who are deaf, hard of hearing or speech-impaired.
